Nintendo is trying to force Discord to reveal the name of Zelda: Tears of the Kingdom artbook leaker

In February, a massive surprise hit the internet when a leaker managed to secure and upload the collector's edition artbook of the upcoming The Legend of Zelda: Tears of the Kingdom. Over 200 pages of content involving the highly anticipated Breath of the Wild sequel were available to browse, months ahead of the game's scheduled May 12th release date. That same day, Nintendo sent out DMCA takedowns to Discord, where the leak had originated from--specifically, a server called Tears of the Kingdom Official Discord Server, which was very much unofficial.

That wasn't the end of things; Nintendo has gone on to take things to court. On April 7th, Nintendo of America filed for a DMCA subpoena, targeting the artbook leaker. They've narrowed down the account name of the person behind it all, but are seeking a court order that would require Discord to give Nintendo the real name, home address, telephone, and email address of the user.

NOA is requesting the attached proposed subpoena that would order Discord Inc. (“Discord”) to disclose the identity, including the name(s), address(es), telephone number(s), and e-mail addresses(es) of the user Julien#2743, who is responsible for posting infringing content that appeared at the following channel Discord channel Zelda: Tears of the Kingdom. The purpose for which this subpoena is sought is to obtain the identity of the Discord user Julien#2743, who posted infringing content that appeared on the Infringing Channel.

I'm interested to see how this turns out. Nintendo is in the legal right to go after the leaker (albeit, might not be worth the money spent, oh well) and maybe this could get Discord to reform its rules. I like using discord, but I will be the first to admit that the service has it's problems, big problems.

At the same time, I hope Nintendo DOESN'T find out who this guy is, because being millions of dollars in debt absolutely crushing to a single person.

Fuck Nintendo for doing this shit and this is why they should of produced more Collector's Editions instead of producing more Standard Edition's of the game. I hope people Pirate that $69.99 Dollar game and give them the finger!

Also fuck most of the employees that work at Nintendo of America, these people are assholes I only encountered one NoA Rep. and she's only one of the good ones that work at Nintendo of America. I also had a bad customer service rep back in March of 2020 he was a real asshole I called them about them taking down one of my Animal Crossing videos on YouTube.

Its Nintendo thing. They always do something like this. Sue everything and everybody. Fuck them. I have hope this new Zelda will be leaked a week before release.

Just because Nintendo CAN do this doesn't mean they SHOULD. Stores break street dates for stuff like this all the damn time, it doesn't give corporations the right to bully individuals and potentially bankrupt them for life. A competent lawyer would argue there's no way for Ninty to prove they lost any sales as a result of it, anyway.

does Discord legally have to disclose this info? pretty sure it's fair game if you sign up to discord with your REAL name but still it'd suck to get sued to oblivion just for leaking a book a few months early. It'd be nice to see discord actually have someone's back in this case but i highly doubt that'll happen

realistically all they'll have though is an email and a username, it'll probably get them nowhere. It'd SUCK if discord is willing to disclose stuff only used for credit card transactions like their name/address though. don't buy nitro folks

Goddamn, Nintendo, relax for 5 minutes. Seriously, could you imagine if they put this much energy into making finished games or supporting their current games? Maybe Animal Crossing wouldn’t feel abandoned
