they have the ability to, but it doesnt seem they have a system in place (yet) to tell unless you play online early or out of country and such
wait , so if i download the poochy and yoshis woolly world i wont get banned because its offline?

This is scary. Remember back when Pokemon Sun and Moon came out and people downloaded CIAs for the game before it was out in their region? They all got their accounts terminated by Nintendo. Of course, these people were playing online and Nintendo noticed it. This game has online stuff right? Will Nintendo notice me if I do this?

Came in here to comment on frame rate....
on my 2ds there is noticable frame drop quite often on this game. don't reallly understand why the game really doens't look that great
Yeah, tried the game on my wifes 3DS and the lag was ehh...
It's runs super smooth on a new 3ds though.
Seems like Nintendo doesn't really optimize their stuff for old 3ds anymore /s
even mario maker has lag.
Yeah well unfourtanetly i don't have a new 3ds and just got laid off.
If anyone wants to donate a new 3ds hit me up.
I'll trade you one of my 3ds' that's already modded with custom firmware

@Jayro, I don't see whats so special about the DS ML, its just a DS lite in a phat shell. At least the phat model had louder speakers, whereas the lite has a much better screen.+1 -

Agreed, that why I try to buy all my games on disc, Xbox anyways. Switch games (which I pirate tbh) don't matter much, I stay offline 24/7 anyways.

@BakerMan - you can still "own" digital media, arguably easier and better than physical since you can make copies and backups, as much as you like.
The issue is DRM -

You can buy drm free games / music / ebooks, and if you keep backups of your data (like documents and family photos etc), then you shouldn't lose the game. but with a disk, your toddler could put it in the toaster and there goes your $60
