Hacking Question Would I get a ban?

So, if I bought a new switch, would it be safe if I initialized the first one which has been banned but without deleting the saves, then deleted the saves for all the pirated and custom nsps, then did a user transfer? I just want to have a clean switch with all my games with no risk of getting banned.

The true answer is nobody really knows. You ran the risk of getting banned from the second you entered RCM and ran code which is not Nintendos own. Unless you have a backup to recover from before doing anything risky then well it is very risky, obviously but that's not to say you might slide through the cracks. If you do have a backup you can restore it but well... Still risky just not as risky imo
