Hacking Will my M3i Zero break my 3ds

Before even going into State laws, Their agreement doesn't say that they will Smash your 3DS system with a banhammer whenever they deem you a hacker. If they stated this, Someone would notice and troll them, Bricking without notice would make them sue-worthy for anyone who has a 3DS.

Either case its a loss/loss for them.
 
Nintendo can't brick your system, even if it's not a federal law (that I know of, I will have to look deeper into that) There would be lawsuits up the ass for Nintendo if they do and Nintendo would lose that battle then lose a shit ton of money. Nintendo won't do anything to harm your system to protect their own ass.
The worst Nintendo can do without facing a lawsuit would be locking you out from online features such as the Market, online gaming, and or web browsing.
 
I'm only guessing here but I think they are well within their rights to simply turn off the operating system for the 3DS.

Negative.

For example, if they brick it for you using a flashcard, that's illegal depending on the country. Mainly because in some countries (I'm pretty sure Canada is one of the countries), Flashcards are legal.
 
Granted. My argument is that if a flash cart is used to play pirated games instead of homebrew or media files then Nintendo may be in it's rights to turn something off. I'm not trying to scare monger people I'm just trying to say it might pay to be cautious.
