Let me be the first one to say the most ethical answer : Buying them in the store.
But other than that Emuiibo won't cost you any money nor do you need to buy anything in case you have a Switch with CFW.

LOL "the most Ethical way" is damn expensive especially the no longer in print ones and emuiibo is fully legal does not use amiibo dumps anymore

Or when your player dies, you can say in code, if enemy exists, do nothing, but if enemy does not exist, then create enemy at certain spot. (This would be a pain tho for lots of emeies)+1 -

Easiest, simple way would be just restart scene, but player would restart from beginning.
