Nintendo have an erpt entry called "NandTotalSize", and has been available since 3.0.0 (source: https://switchbrew.org/wiki/Error_Report_services), so you can expect a ban if you upgrade the NAND size. However, the guy you are referring to wrote a guide where he said he hadn't been banned as of the writing of that guide, so who knows. Either way, I know I would risk a ban for a 256GB NAND size if I had the skills and tools to do so, but each to his own I guess
