technically speaking you don't NEED emunand, but you do need a GW?

im thinking if you get devmenu/bigbluemenu as a .3DS and put it on the microSD and just run it from the multi ROM menu in GW mode without formatting emunand, then install the update as a .CIA from there, that would work right?

Yes, I meant that you can only boot classic mode, to play retail games right? Not emunand to play roms and cias

If you boot classic mode, you boot into emunand automaticly, and there you can only play retail games, but to boot into 9.x emunand you need gateway, so if you boot into emunand without gateway it just gives you a blackscreen.
