Hacking Transferring from banned modded Switch to non-banned, modded switch

Recently got banned on my switch and plan to get a new one and transfer my Splatoon 3 save files. I know both have to be modded but I want to make sure if it's safe as long as the game was never modified? or would it count as "save editing" and they'd ban me anyways. It would be on a new Nintendo account as well, not the same one from the banned Switch

I wouldn't chance it, you may get the new one banned also.

Any kind of save editing in an online game has a major ban risk. You can risk it if you want but you can never be 100% safe when it comes to online stuff.
 
I've edited many saves on my hacked Switch and transferred them to my legit one perfectly fine.
Though I imagine this isn't possible with a banned switch due to well, being banned.

I'm not save editing, I'm retrieving unmodified saves that I already had from my banned switch
You can simply use Checkpoint or JKSV and backup your save to micro sd card, then on the new modded switch, use same program and restore them from micro SD card.

I've contacted support and they've told me it's only a console ban and if I use the account on a new system it should be fine to restore save data from the cloud

Did you have a paid NSO subscription, and did you back up game saves to the cloud before you got banned? If so then yea should be good.

Yeah I was paying for online and the saves were being uploaded to the cloud (it autosaves). I thought console ban meant all accounts were banned on it as well but I guess not
 
Nintendo will only ban your account if you commit fraud or do a charge back, or if you did something absolutely atrocious.
