That doesn't answer my question, also it's not pirating, I'd use a copy of my own game, which I'd happen to sell some time later and perhaps someone would use it online later and get banned themselves. It's hard to imagine they have serial numbers hidden on every cartridge data but I guess it's not impossible and there have been people getting banned for using pirated (not self dumped) roms in the past.
Crazy, thanks for the information, well I guess it wouldn't trigger in my case but if you use pirated ROMs you got from some site that are mass distributed they for sure are getting flagged. Begs the question though, why Nintendo wouldn't include a ban into the software updates for those pirated rom copies, so they can ban switches even when they're offline/have the Nintendo IPs blocked.
