Hacking Sysnand formatting (tinyformat) and error 005 5964 OLD 3DS

So I have an Old 3ds which was banned for illegal digital games sold to me (Error 005-5964). However I can access homebrew, downgrade and install CFW. I know Tinyformat separates the sysnand from emunand, but If I format the sysnand and create a new NNID, the ban would get lifted?

Looking forward for your quick reply. I really miss go into the Eshop, even when I can install Cia games. But I do.
 
Downgrade and install CFW, then format not the sysnand, but emunand, and try if you are able to enter eshop with new nnid

The ban is most likely console and possibly NNID related

Trade the console towards a n3DS XL at gamestop or another game store and at least you can recoup some costs as they do not check for that error and a new N3DS XL should still be below 10.3.
 
I'm sorry, but I don't really know what that means. I mean cia's and stuff are pretty safe from what i've heard. Or did he play with a public header?
Firstly my apologies, I didn't realise you were asking for clarification on "illegal digital games sold to me", I thought you'd simply failed to read the first post. Secondly, what may seem obvious to me may not be so obvious to others.

To me it's "obvious" (because he said stolen not pirated), that what happened was that he bought a 3DS which was filled with eShop games that were purchased with a stolen credit card.

That's not the only scenario, but I feel it's the most likely one.

I saw on internet tons of people having the problem solved calling nintendo and telling their situation.

So,he redeemed stolen serial number from Amazon or something like that?

Exactly that happened. However I heard someone formatted sysnand and emunand aand linked a New NNID and lift ban off his console... But I'm afraid to try it myself. Even so, would I lost all my save data as the new NNID is different after the format?

I tried that already and they denied any possibility to lift it. So that's why I'm asking help from the Dark Side, per-se
