I remember this like nearly 3 years ago lmao. Didn't know there was a downloadable version. I'll test to see if this works in Wine.
EDIT: Theoretically should work in Wine, although all Unity3D games normally give an dnsapi.dll error in Wine which there is a workaround for.

They can't C & D this game because the developer took advantage of a legal loophole. For example, instead of using Mario as the name of the character the developer chose to name him Mayro, that way, Nintendo can't do a thing because Mayro isn't one of their trademarks. Also, notice how characters look a lot different than the official ones, the game has absolutely no code from Nintendo, so it's completely legal.

Sorry for the late reply, but Nintendo is still Nintendo. They still give copyright strikes to youtube videos despite them falling under Fair Use. This doesn't mean Nintendo will win, but it does show Nintendo isn't afraid to throw their weight around. It's just shocking Nintendo didn't try to push something just in an attempt to rattle them, even if was an empty threat.
