My switch is partitioned in Sysnand and Emunand. If I want to play Smash with mods online should I try and get CFW in sysnand and install them there? Or should I do it in Emunand? Don't want to get banned and I know it's possible.

No mater how you go about this you're going to get banned unless you do LAN shenanigans
 
Just visual mods. I used to do visual mods on my old Switch and play online without a problem or any lan-play
I have heard a few other people say that they've managed to use CFW on SysNAND without getting banned, as long as they're not using it to cheat in games or for piracy. That being said, I've also heard other people swear they only stuck with homebrew, never pirated, never cheated in online games, and still got banned. So it's not something I would risk.

Only Nintendo knows for sure what criteria will and won't lead to a ban, and I'm not sure they're consistent with it.

Yeah that's true, I was using mods for like 2 years and nothing happened!
But I was wondering if it's any different on an OLED CFW, and if I should do it on a SysNAND or EmuNAND
