Hardware Sleep mode crashes

Hello everyone, i recently had an issue, since my 3ds was updated to b9s and luma 8.1almost every time i exit the sleep mode the 3ds crashes, tis only happens in game, does anybody knows if its a physical defect or software?

Or if anybody had the same issue
