Hardware Right Joycon Connection Issues

I've been experiencing issues with the right Joycon not registering button presses from time to time. Currently my switch is out in the open and I'm only sitting about 7-10ft from the TV/switch. It seems to happen more when the Joycon is lower on battery.

I looked up this issue and it seem that Nintendo recommends to update the firmware and then if that doesn't work send it in for repair. Problem is that I would like to keep my firmware as low as possible to be able to use homebrew (currently sitting at 4.1.0 which came with the switch).

Has anyone had a similar issues? If so, does upgrading the firmware fix the issue? Is there a way to fix the issue without upgrading the firmware? I'm also wondering if this is an issue with the controller or the console. If it is just the controller it might be just easier to buy a new joycon. It would be nice to get this issue fixed without having to hand the console over to nintendo or update firmware. Let me know if you guys have any idea or need more info to know what's happening.

I'v only recently developed a similar issue. At complete random, my right joycon seems to stop responding to button presses, and can even repeat inputs rapidly or spin the camera constantly for a few seconds. I thought it was the classic joycon desync issue the switch had at launch, but its the right joycon, not the left, and this post is the first time I'v even seen this mentioned for the right one.

There are updates for the joycon themselves that are bundled with later system firmware. Would recommend updating joycon firmware by inserting them into a Switch with later firmware and allowing update to complete.

*note*
Updating your joycon will not have any negative effect on your CFW or banned status but can cause issue if you RCM modded your right joycon by permanently shorting out pins. Use Reed switch or button switch for joycon mods.
