Hacking R4 without ban risk?

Hi everyone,
I've barely used my account, so I guess you can say I'm new to it.

The thing is I have a lot of DS games in a R4 flashcart I use with my DS Lite, exactly this one (see attached file).

I recently bough a New 2DS XL and I know that hacking the console can get you banned (supposedly only if you do weird stuff like using hacks online or playing games before release, but still, it is not asured that you will not get banned... right?).
I tried the flashcart in an old 3DS and works perfectly.

My question is: Can I get banned for using the R4 in my New 2DS XL just to play DS games or emulators? (not 3DS, just DS games).
I ask this because to play DS games, the console supposedly goes into DS mode, and in any moment I'm going to play online since Nintendo shut down their DS servers.

I will summarize the questions:
1. Can I get banned for using the R4 in my New 2DS XL just to play DS games or emulators? (not 3DS, just DS games).
2. Does the R4 get caught in the activity log of the console?
3. If it does, does the 2DS XL know its a flashcart? Or the console interprets it as the game that shows up on the menu when you insert the R4 (to make the console think it's a game and not a flashcart)?

I think not really they ban you I was using my DSTWO for years - but only thing that is recorded to the system is what game you're using since 3ds have log about played games and as far as i know DS flashcards is recognised as game for example DSTWO have probably ALEX RIDER STORMBREAKER, but i have some R4 card (that somehow bricks itself). I prefer DSTWO since I think that is designed much better like other ones, also have build in CPU and have specially designed homebrew emulators that operates very very good with them.

How did you find out it's secure? I couldn't find anything, I've been googling for hours...
Do you have a link or some sort of proof?
I really want to be sure that the console won't get banned ):
1. There were no reports to this date.
2. It shows up as a DS game, that's all they can see. That you are playing a DS game.
And I highly suggest buying a flashcard with which you can hack your 3ds.

no I've been using my r4 forever now they can't see what it is only that you played a cart and don't bother with DSTWO unless you want to waste battery even when not using the cart but the only carts they ban are 3ds carts BUT thats only when you try to go online without a unique cart header...hell if they were going to go after r4 cart usage with bans you would think they would do the same with vc injects which they don't

Download play is local. You aren't connecting to Nintendo's server to do that. There's no reason why it would be any different from just using the flashcard yourself.

When not using download play, the flashcart shows up as a ds game (in this case touch bomberman), but if you host download play with a different game stored in the flashcart (say nsmb), couldn't the activity log or something go crazy and notify nintendo? I'm probably completely wrong, and sorry to reply to your answer. A friend used his flashcart on my 3ds (i'm not into piracy) and i'm afraid of a possible ban

No they can't detect it. The 3ds has been out for over 9 years and there has been zero people banned for that reason. As stated hundreds of times in various threads on the temp the only way to get banned is.

1. Cheating online
2. Playing a game online before realese (which is no longer a problem as no new games coming out)
3. Using a stolen credit card in the eshop.

There are zero reports of bans for any other reason.

So in the activity log the game would still show up as touch bomberman, even though download play was hosted? Thanks!

    Is it piracy if it was released for free? Not in my opinion, but I also think it's not piracy if buying it isn't owning it, and it's not piracy if you can't buy it from the original creators anymore.
