If you download a game from freeshop are you actually downloading the game from Nintendo's servers?
 
You can download it directly from the server as long you have the title keys

But it is not recommended to download and play the online services such as Pokemon as you can be banned

Freeshop works with CFW such as Luma3DS
 
If your isp can notify you of a dmca violation from downloading a file p2p. Im sure nintendo can see who's connected to their servers. They could come after you if they wanted.

There is no P2P file transfer involved so your ISP cannot dmca you but Nintendo can directly ban your console

People have been banned from Pokemon Sun and Moon because they played before the release date, not because they downloaded the game through freeShop

They can't. You can download from your PC.
Nintendo can't ban a 3ds by their IP address.

The only solution for Nintendo to prevent that, is to add a layer of security.

I dunno why people here promote freeshop so much. Seems too risky for me.
Look, you can ask pretty much anyone who has CFW (which normally 9 times out of 10 means they have freeShop) and they'll tell you freeShop is great. There are no recorded issues with it (as far as I'm aware) and if you decide that it's too risky, that's your loss. I mean, feel free to prove me wrong, but I've only ever heard and received good from it. :)

Thanks everyone for the explanation on how it works. But I don't think I'll be using it. Too bold a move in my opinion. But thanks for explaining it.

I might be the minority, but I'm actually not using Freeshop. Not because I think it's "risky" or something.. but I find it more convenient to open that title key website on my PC or laptop and simply scan the QR code with FBI. I'm still quite new to A9LH+Luma so I've been testing different methods to find the best one for me including Freeshop, CIAngel, installing tickets and downloading via eShop, moving .cia files to the SD card etc.. and I figured that FBI+QR scan is the fastest and easiest method for me. Faster than launching Freeshop and typing different titles with the on-screen keyboard.

Yeah, that's also the best solution to find a japanese title.

FreeShop is completely risk-free. It's impossible for anything bad to go wrong, but me saying this probably won't change your mind, I understand that feeling.

But you have a point, QR code + FBI is indeed faster, and I can type in Japanese, something I can't do on the FreeShop :3
