I think you could patch your .3ds ROMS with Gateway ROM Patcher so that the manufactrer of the ROM matches your header.
If you change your Kid Icarus ROM Manufacturer to Macronix 45 then your 45 Header will work fine with it. You'll have to say byebye to your save file though
