Gaming Pre installed games help

Just purchased a used 3ds xl from cex . This was a limited edition version with super smash brothers pre installed but during there factory reset process it's no longer on the system

I was hoping to download the game again from the E shop but it's asking for £39.99

I'm assuming it's lost forever as I'm a second owner but was just after advice cheers

You can buy the cart for cheaper, most likely. Check on amazon, usually $5-$15 cheaper here in the us.
