Just remember, (at least currently) only entrypoints on 10.6 are Cubic Ninja and Ocarina of Time. If you're on 10.4 or 10.5, browserhax is still an option for you.

Maybe, but they wouldn't release it to the public. They are fairly anti-piracy and feel that userland is enough.

Smealum, despite his major influence of the scene (he was the one who released both Ninjhax in November 2014 and more importantly *hax 2.1 in July 2015, the first wave of exploits to be usable post-9.2, thus opening the "market" of creating custom code specifically for the 3DS), is kind of a dweeb when it comes to the CFW side of things.
