I might send an e-mail or something maybe. I've only noticed smudges once maybe twice but they wiped off.

I'd put a screen protector on my top screen but I can't for the life of me get one on without bubbles, I managed the touch screen fine.

Simple solution is be careful closing your DS and if you carry it around put it in a protective case, simple really.

- My improvement on the "fix" posted above. The original one still allowed the bottom frame and top screen to touch with very slight pressure, and I mean VERY slight. My little position change for the rubber nubs makes it so they will not ever touch except with intentional force.

I know it's hard to see, but the rubber nubs elevates the top screen enough so it never makes contact with the bottom frame.

I would be concerned that if you keep that in your pocket where pressure does get applied to it, then it will eventually wear down the hinges or cause some other damage.

My text in that pic should explain it. But on top of that, it will cause the upper screen housing to bend, and although unlikely, it could break the screen. Thats not a chance that I'd be willing to take.

I will stick with my microfiber cloth as a protective layer.

I was wondering how well you would be able to explain something so physical in words. Thank you for your diagram it really helped explain your point and I understand but I will take the risk as I percieve it to be a negligable risk.

They come from an Xbox 360.

But which method are you saying is solid, the rubber feet or the microfiber cloth.

So what part of the lower area actually scratches the top screen? The Start/Home/Select buttons? Because I have a Zagg invisible shield on, and that protruding lower area is covered. The screens aren't though, I'll be using a Hori screen for those, once it comes.
 
over 100 votes, we have a clearer picture of how bad this defect is now.

25% of you are having this problem, thats huge, factor in the 50% or so of you are reporting smudges on screen (which unfortunatly turn into scratches with ease) then Nintendo habe a massive issue here.
Thank you for all of your replys, suggestions, and help.
Anyone care to relay the results to Nintendo? I am abroad for the next 3 weeks and can not link or attatchments in emails from this system.

Then what are they from? And why do they line up exactly with the lower screen?

I have a feeling that you are just too much of a fanboy to accept that Nintendo can create design flaws and then lie or make excuses to cover it up. You need to get your head out of the sand.
 
I don't see any signs of scratches on my screen, but maybe it's because I put on screen protectors. Got the annoying wobble problem, though

Yeah, I just realised the scratches, i got 'em BAD... I'm using the foamy thing that it came with for now... Anything I can do about it?
 
All I had is a smudge line that was super easy to wipe off, but it was only visible when the sun is directly on the top screen. I can't even notice it when I'm indoors so its not even a problem for me. I've checked my screen again and there was nothing this time so I think it just happens every once in a while for me.
