Just got in my brand new sealed New 3DS XL, before I open it can I mod it and such, can I get Pokemon Bank + get it actually working to send it to Pokemon Home?

I messaged someone that is selling a used new 3DS XL, thats already been modded, and he didn't have Pokemon Bank but he said he downloaded it got it to work.
He told me he just opened it and it loaded for him, he didn't try to actually use the service.
So whats the deal, is it true possible to get Pokemon Bank working if it was never used before?
