What firmware do I need to use to get it working? I'm using 1.56 Beta 3 and it still freezes.

Will the new 1.56 Beta 5 work with it's "Stealth Mode"?

It works with 1.56B3, try the standard stuff (Panasonic Formater, redownload game)

Well it works for me with 1.56B5 so I'm happy.

It actually worked fine with Beta 4(which I had when I fist got this) aswell, still Beta 5 does bring us native Spirit Tracks support..

Beta 5 brings native Zelda: Spirit Tracks support for the USA version only. Unfortunately, the Europe version still needs the patch, so if you're in that region you're going to have to wait a while longer.

As for Phantasy Star Ø (U), the CycloDS Compatibility website reports that there is a compatibility issue - "Game timer resets to 999:59 after returning from the enhanced menu" - so you may want to watch out for that.
