Don't update, it will change your sysnand to 9.5 which is BAD.

We don't know the full functionality of Gateway on the new 3DS yet. We do know that you will be able to play ROMs, but the possibility of emuNAND has yet to be seen. EmuNAND is what allows you to download updates/access the eShop normally on a 3DS.
