1.is there some other way to have the game patches/updates than eshop ?
2.do we have to update firmware to access the eshop and
download game updates (as for the 3ds) ?

If you have automatic software downloads enabled, they will be downloaded for you automatically and installed the next time you launch a game. And yes, you must be on the latest firmware to access eShop and download games/updates.
