Ninty, you're a bit late on downgrade protection.
Then again, all your security is lacking.

To be fair it's still impossible to downgrade unless you previously created a backup from that specific 3DS.

Same goes for the PS3 in the early days.
And in the early days of the Wii as well.

Maybe soon someone will figure out to downgrade the 3DS with a update package, much like the PSP.
That or there will be a HBC (which is more likely)
 
Not sure if some of you saw this but apparently there are whispers of a hardware mod to the 3DS. Perhaps this is meant to prevent hardware mods?
 
This may be something to enable the writelock on the nand and prevent people from downgrading to 6.3 when Smea releases SSSPwn.

Actually, this theory makes sense.

Recently nintendo mentioned they were working on cheaper consoles to enter into developing markets. It would stand to reason that people that can't afford to get a more expensive 3ds XL would likely not be able to afford the $40-50 games. SSSPwn would allow people to play HOMEBREW games for free
