So are you and like i said, we're both no lawyers so lets leave it at that

I'm not making bold assertions. I've mentioned the EUCD, which is easy for non lawyers like us to find details about & that courts don't like it if you break the law and then try to get remedy for your losses.

Sony have banned lots of people who then lost purchases and there doesn't seem to be any court cases, if the law was so clear cut then there would be a trail of court cases.

I doubt anyone will sue Nintendo either & only a court can tell them what they can and can't do.

Oh I meant the thread in Backups about 'N fixed CDNSP' which happened two hours before this thread where the cert stopped working but others were able us their own. Maintenance taking down the server shouldn't have coincidentally only affected a highly suspect cert. That's either the oddest coincidence or it's not coincidence.
Oh now I see what you are talking about. So then, its more of a matter of whether the users themselves actually have a "superban" or not because the "superban" is real as evidenced by the CDNSP-certificate no longer working.
 
The certificate from that YouTube guide works again? I tried downloading a game using that cert via FreeShopNX and it worked but didn't work a few hours ago...

FreeShopNX uses your certificate. CDNSP' uses a baked in public one.

One law can easily be dismissed with another in court. That's how it works so yeah we're both making claims wich we can't proof so i rather leave it at that. I don't get why you keep going and want to win this argument when we're both no lawyers and this would keep going in circles. I am not gonna respond to this anymore. All i'm saying we're both no lawyers and laws can be dismissed by other laws so googling cerutain laws ain't gonna help. I rather leave it at this, i just gave my thought wich i don't claim to be 100 percent correct since i haven't studied law and order and you also didn't.

I'm under the impression that FreeShopNX only uses the spoofed certificate for registering tickets, and not during the download process, which is where it really matters.
Of course, if there's evidence to the contrary, I'll take it.
 
As someone mentioned above, there are game carts that require day one downloads to function. Surely, Nintendo are on shaky ground if they block your ability to play those carts. It's more complicated than just losing the rights to online services due to tos violation in this case.
I'm not aware of any cases that have handled this sort of situation specifically. Someone could challenge them on it and see what the judges say.

But unless someone takes them to court, Nintendo are free to do whatever they want. No amount of "B-but, I don't think they can!" is going to change that. They can and they will.

Until then you can just take the game cartridge back to the store you bought it from.

I remember a few hours ago I was getting the same errors others were getting with the version of FreeShopNX I had (with the provided cert) but now it works again. weird
 
The French guide provided a Certificate.cert file that isn't mine, I think I heard somewhere it was the same cert from CDNSP?

One presumes this functionality was intended to be implemented - go figure - some time during development.
Not like that stopped people from distributing builds of it and going buck wild.

It certainly sounds unfair, but what law do you think they are breaking?

On a physical game then you could probably get a refund from the store you bought it, but I'm not sure they are legally required to do so.

(well, i was already banned from playing online but i guess i wasn't CDN banned (yet)) :P

Are you (or anyone else) going to try and complain to nintendo when they ban you for piracy when your 1 legitimiate game doesnt work? Good luck with that, seriously, not a cat in hells chance.

The number of actual reported cases is actually much, much lower than one would expect.
Of course, that's not to say they couldn't start banning people for downloading things they're not supposed to, but it's a theory for the time being.
 
Theres a handful of maybe-bans, the main one was the public cert as that stopped working while others could still download by using their own cert.
When I was getting errors downloading from FreeShopNX I was still able to update my games without any issue, and I can still check for updates. hmm

there's no way ninty isn't gonna go hard on the banhammer, i'm sure that everyone who used FreeShopNX is gonna get banned eventually, but the invalid requests possibility makes a lot of sense
