Well I can believe that someone could be mistaken about 7.0.1 vs 8.0.1. Both of them would require an update at least to use online, and you'd have a hard time checking if you updated. Bit harder to be wrong about 8.1 if you connect online.

I've bought the new switch in germany some days ago with these properties:

Firmware: 7.0.1
Model: HAC-001(-01)
Serial No.: XKJ1000XXXXXXXX

They seem to range from 7.0.1 to 8.1.0. None of those firmwares will get you anything super special, 8.0.x and 7.0.x might get limited homebrew support in the future though /shrug

XKW is for america, other regions have XKJ.

As of now no unless it comes on firmware 4.1 or lower.

not even that, this new switch uses a brand new bootrom, meaning that no exploit discovered works here, even on vulnerable versions
