So quickly breezing the last few pages... Everybody banned so far had attempted to use the Mig Switch before updating it to the latest Switch 2 compatibility update..? And there appear to be a handful of people who are not banned, but who did not try the Mig before the new Switch 2 compatibility update and only used it since updating it to the latest version?
Best to wait a week or two and see how it turns out for those people. Bans come in waves so they may have just dodged it.

The NSO upgrades require online checks from time to time. Same case with the NSO apps.
What about if you legitimately purchase the upgrades without the free NSO discount, would those versions need to phone home after some time and just stop working randomly if you had your switch in airplane mode?

If the virtual gamecard is loaded onto the system and it is tagged as the primary system you can keep it offline without any issues.

If you purchased say the digital upgrade for Zelda BOTW and you own the physical cart, does your system need to be online for it to check if you purchased the upgrade each time you power on your system? Or each time you try to launch the game? Or can you just put it in airplane mode after you purchase and launch the game as many times as you want after that? I was thinking if this is true then people that got the upgrades free via their existing NSO service could put their system in airplane mode right before their subscription expires and therefore keep the upgraded Zelda versions forever without paying for NSO further.
i bought the upgrades from the eshop, totk just worked with my xci, botw didn't because it was a lower version of the cart and it needed an update. borrowed a copy of botw just to insert and update and now it works fine. all of this could be done offline after the initial upgrades are installed from the eshop.

The New Mig flash Does Work with an express card But Nintendo Can Detect it and they are already banning anyone who puts it in the switch 2 :creep:

Yes and disabling online functions isnt against those laws. Fully disabling the system is but just limiting online functionality is perfectly fine.
No, disabling posibility of game updates, and moreso, downloads for keycard only games is, in fact, functionality limitation. Stop it, it is childish revenge, that's what it is. Nintendo is doing it for persuasion, not for actually defending or keeping anything safe ( online PLAY being the correct example ) but the people trying to defend it as anything else but intentional and unjustified crippling is just childish.

I'm sorry but you very clearly just seem to want to be angry and not actually take into thought that... this is nothing new and has never held up in a court. Online/store bans have been a thing on consoles since online gaming began and have always been viewed the same. They work basically identically here as they have on all prior platforms that implemented this functionality. Which basically every system from 2005 onward does.

If the only way to get a game or its updates requires a service and the service is forbidden, then there is clear functionality loss. That functionality loss can only be justified if it ITSELF puts something at risk in one or both sides, which does not. Again, this, in the EU, doesn't stand a chance, no matter what any shitty TOS/EULA says, even if you sign it 1000 times or you do so with your own blood, it doesn't matter.

Just updated my mig switch to 1.2.0 but its still not working on my switch 2. It reads the games but the games don't launch. My mig switch is a v1 if that matters

EDIT:
Taking out the game card while the light is green and putting it back in causes it to work
Update: since the update didn’t work for me the first time, that means my console has been flagged and I’ll probably be banned. Btw you will only get flagged if you get an error saying the game can’t start. The mig software is amazing guys !!

Why are people using the mig on switch 2 in the first place. The only reason to probably want to use the cart on switch 2, if somehow it will be able to play actual switch 2 games when they can be found online or backed up.

switch1 games are performing alot better on a switch2, even without an switch2 patch

I updated my previous comment, but for anyone wondering, my Switch 2 has been console banned because of my attempt to use the MIG switch on launch day. This is despite using a clean rip of my own games
even though you are banned can you still play them games? or does it stop you playing games altogether?

well hopefully this is as far as Nintendo still goes when it comes to bans and not actually brick the consoles. I don’t mind buying a banned switch2 at a proper price when an actual hack gets released. I just don’t know if these online bans stop a user from getting game key card downloads, if someone already answered that in another post, I’ll probably see it. I know my banned switch 1 can still get switch updates if I unblock Nintendo servers, maybe switch2 will be the same when it comes to system updates.
