Whoops, looks like they are actually legal in the states. I went back to my old FEPlanet discussion about them, and the R4 was deemed illegal in Japan, not the states.
Just a curiosity, why no US-based mod stores?

Well, the existing US stores are horrendous, so I'll be having a go at it as soon as everything is registered.

According to the DMCA anything that circumvents a protection system is considered illegal. Although, there is also a clause that says you have fair use to backup the game/movie/music cd/etc for if it fails. But then you are not allowed to run the backup with a flash cart or burnt disc....
Stupid laws...
