How does the switch know it is docked? Is it a chip inside the dock? Does it have to do with the TV output module inside the Switch? Does the dock possibly even inject a payload to let the Switch know what is happening?

This is not firmware related. Any USB Hub is treated as OTG. Otherwise it won't work.what if you modified the dock firmware?
