If you are currently on 11.5 without cfw then nothing has changed, you need either the dsiware transfer method (requires another hacked 3ds/2ds) or a flash cart with ntrboot (the r4i gold 3ds rts is the easiest option for that).

Yup i have the flashcard i was going to do it today because a sold my old 3DS but is scary every update lol

But if that update is a prelude for a ban wave, or maybe breaks some options on luma?

Yeah, either a banwave or a cfw timebomb that does something nasty if you are on cfw. Thus I suggest a full SD backup, not just a nand backup, before doing the update just in case.

Something to detect if you have cfw but rather than doing something immediately, waiting for a while before doing something like erasing your installed games or whatever. But I doubt Ninty is that smart.
or frying your nand. that is a option too.

Nintendo will be protested like hell if they setup a CFW timebomb, it is okay to prevent someone from doing something to their devices via security holes, and so is banning them from your exclusive services, but modifying another persons property in a unethical way will really get them screwed. They can't ethically modify your device if you don't allow them to, it is that simple.

That would be highly illegal.

Well, you may just have give them the idea. ^^
