I have one of those wii's it takes 1/29 tries for my wii for it to boot, It sucks but i cant send it back due to the HBC.
you can buy a new/refurbished/used or the like dvd drive for the wii it's only about $50.
that's not bad considering Nintendo will now charge out the ass for repairing a hacked wii and or upgrade it to 4.0 compared to that it's not that hard to open a wii up and pop in a different dvd drive.
also sounds like your bluetooth module is loose or dieing if it only boots your wii to system menu 1/29(or do you mean it only boots DL games every so often?), you can replace them also pretty cheap.

It only boots DL discs 1/29 times and i cant find a english SL disc of SSBB. Sometimes i get lucky sometimes i dont, ive done it up to like 50 before w/o boot. But its not worth sending it in or paying 50$ for a new drive.

well if you can't shell out the cash you can try cleaning the laser.
also no not with one of those shitty $5 disk that have bristles on them that don't clean shit, you will have to open it up and gently wipe the lens with a Q tip with maybe a bit of alcohol on it.)

Are there any lawyers on this site who could settle this issue: If there is legitimate defect in workmanship (i.e. wii will not boot DL discs) and you have the Homebrew channel installed, can they refuse to repair your Wii at their cost? And if you can tell what country (and state if in the U.S.) you practice in, I think it would be helpful to everyone.

So...how much power does it take to damage the NAND so it can no longer be read, but not enough to melt it?

i'm not a lawyer but i know afer of them, and no it'd take a high profile lawyer and most wouldn't even take the case if any cuz of how minor the issue is.
the warranty is void even so since installing anything on the wii not made by Nintendo/using anything not made by Nintendo on the wii is in violation of the warranty.
on the other hand so long as the terms of it are met(or seem to be met e.g removing HBC with any title deleter along with any pirated wad and channels not on a virgin wii or you didn't buy) they will fix it, if not you have to spend a bit of your own money and DIY.
that is so long as it's not a brick and it's just a part that needs replacing even then electrical damage is easy to fake such as poring a drop or two of water on the nand chip to fry it making it look like legitimate hardware failure.

I was actually thinking more like a consumer protection law that would supersede the warranty (similar to the lemon laws on cars.) But, you shouldn't have to go through all the trouble to fry you NAND chip to fix something that isn't your fault. How binding can the warranty be, after all I never signed anything.

The reason I ask is the part at the end of the warranty:
SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS OR EXCLUSION OF CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

This warranty gives you specific legal rights. You may also have other rights which vary from state to state or province to province.

I looked up the law in my state (IL) and found this:
"Prohibited tie-ins include tying a warranty to the use of only authorized parts or to a certified product, and giving a longer warranty for a product when purchased with a tied-in product." Source

Wouldn't this cover nintendo's clause:

"THIS WARRANTY SHALL NOT APPLY IF THIS PRODUCT: (a) IS USED WITH PRODUCTS NOT SOLD OR LICENSED BY NINTENDO (INCLUDING, BUT NOT LIMITED TO, NON-LICENSED GAME ENHANCEMENT AND COPIER DEVICES, ADAPTERS, AND POWER SUPPLIES);"

If i was nintendo, i would have been really pissed about the following people:
"I didn't want to pay for games and i'm too stupid to read, so i bricked my Wii. Nintendo repair it on your costs, now!"

If you pirate games that's one thing. (Piracy is not theft, it's piracy) While it's bad, it doesn't produce real costs for nintendo, "just" less profit. Being too stupid to not brick your Wii and then letting nintendo clean up behind you generates real costs.

I hope nintendo only charges the 210 Euro only if your Wii is bricked and not if your drive isn't able to access DL discs. Even when i'm aware that reading DVD-Rs is more work for the drive and reduces it's lifespan more than reading retail discs.
