When I went to Jam Session's press presentation, there were some DS available with the game to test. The cartridge were some kind of linkers too. They said it was an "Official development flashcart".

There is a clear difference between Official development tool, and flashcart we all use..(I really don't mind them using flashcarts, it's just funny to see one in a commercial for product that is Licensed by Nintendo)...

I don't get why this is such a big deal. Official Nintendo developers used Supercard SDs to test multiplayer without having to ask for more development carts from Nintendo. In fact there's a long dead thread about it on gbadev I remember reading. The supercard Software would refuse to patch an SRL image

It's not a big deal, the whole topic started off with a funny fact, that M3 Real is used on the "official" commercial for Nintendo Licensed game..

I see no problems with any developers using flashcarts from "the scene"..
