That's a common misconception, changing the SpotPass settings or turning off showing your currently playing game changes nothing. Your currently playing title is sent to Nintendo whenever you're online and if nothing is running it sends your last played title.
That's why it's recommended to not run CIA homebrew or VC injects while online, although we don't know for sure if they use that as a criteria for bans. .3dsx homebrew ran through Rosalina with hb title set to Download Play is safer since they'll only see you as using that.

LocalFriendCodeSeed_B aren't allowed to be shared or linked on this forum as they're considered warez, so you should remove that link if it does indeed contain that.

Anyway, a lot of the ones you'll find online are already banned. The public ones get banned semi-frequently.
You can use a public one but be prepared to have to switch it out every couple months.
That ISO site had a working one last I checked. The thread gets updated with a new one whenever one gets banned.

It's a couple of things, the first is a unique file on your system (this is the one that's replaced in the unbanning process)
Making a new emuNAND will just result in the same file being copied over again as it never changes.

And the second is a certificate stored in the 3DS bootrom that can't be edited directly. This also gets banned and is the part that prevents you from using your NNID or anything that requires NNID login like Badge Arcade. The only way to change this is with a modded CFW that doesn't exist publicly that injects the modded certificate. But you can still play online and buy stuff on eShop as long as you have an unbanned LFCS_B and you remove your NNID from the console.

I seriously doubt that. lol. But okay.

It doesn't it doesn't matter what you think.
People have sniffed the traffic sent when the 3DS connects to the servers and verified this. The proof is posted somewhere on the forum. If you want it, I'll dig it up.
Whatever the SpotPass data sending setting is for, it's not that. And disabling displaying your currently playing game to friends does exactly that, and no more. It's just not displayed, Nintendo can still log what you're doing.
That being said we don't know if that's how people are getting banned.

Its a brand new console.

So if there is no wave ban its great. Maybe something worng here.
I ment private seeds not public,my bad.A private seed is either a seed that comes with your console or a seed that you got from your very own secondary 3ds that hasnt had its seed shared anywhere. If multiple private seeds are getting banned at the same time, then its a banwave.
