Hacking Games installed with CFW (FBI) won't connect to other devices.

So, I recently got CFW and downloaded several games, One of which being NSMB 2 SE. Yesterday, I tried playing co-op mode with my brother, but for some reason, my 2DS couldn't seem to find his. Could this have something to do with me turning off spot pass? Or the game being installed with FBI? Please help.
