Homebrew Freeshop gets DMCA'd on Github...

So no more updates or cache updates?
It can be updated since lot of people have actually the source. It will take some time to @TheCruel to adapt himself for notabug,but everything could go back.

Like seriously has not a single person on this forum been DMCA'd before? The repo can literally be reuploaded with a different name and the incriminating stuff removed. When Github DMCA's anything it's always the entire repo no matter what it might actually be. They don't do single file takedowns as they would need to wipe commits and then it gets fucking messy.

But....... do we realy know if these are nintendo? Maybe it's a temper that want to see community reaction X)....
 
github is a reputable site, they are pretty much obligated to comply with legitimate dmca requests, if it was uploaded to a less reputable site then the dmca requests would no doubt be completely ignored

that said gbatemp also does not link to known illegal files, until freeshop is amended to remove the offending files (banner etc) it would have to not be linked to directly

Well hey I mean it's true, but in this case TheCruel or whoever reuploads the source, would need to remove the nintendo logo, and then explain in full detail how everything works. Because Nintendo themselves "doesn't believe this".

Nintendo believes the freeShop application circumvents Nintendo's protection measures.

They cannot prove that the freeShop circumvents anything the 3DS wasn't already made to do. It's literally downloading from Nintendo's servers without circumventing anything because there are no security measures in place.

reputable.... Is this normal that you host source but you aren't open? That's why I love notabug.

Was the logo in the source? or just the release(s) due to the buildtools...

I dunno but what I can tell you is an intern made this call, not Nintendo. Because if it was a real lawyer then they'd have used that logo excuse on just about every single repo that produced a CIA, and used that logo. It's just a bluff which they will win because just about everyone has that logo in their CIA releases.

It's a shame that TheCruel probably doesn't have the funds for a proper legal defense. I know that if I did I would fight this. DMCA abuse is bullshit, and in this scenario, Nintendo is being a bully. They know he probably can't properly defend himself, even though they're in the wrong for the most part. The issue about the logo is just nitpicking, though.

Well, better update my title keys periodically in case they take that site down. They still can't remove the app from my 3DS nor remove title keys from my system.

Yeah, I know. I was moreso talking about fighting the claim that freeShop's sole purpose is purveying copyrighted content illegally. He most likely wouldn't stand a chance against the claims against the graphical properties, so it'd be kinda pointless for him to fight that.

We can still run the application afterwards even though it is taken down however, right? And as for the titlekeys, we can still download all the games from Ninty's servers as long as we have the specific game's title key, correct?

They COULD tell a legally purchased title apart from any other generic source. That needs analysis of the sort that could bring down all their servers from sheer workload, like what happened with Pokémon Bank oh so long ago, and cost them more money than any piracy would lose them.
Had to say that. Because this is probably the real reason to be honest. A simple check multiplied by millions is a self-inflicted DDoS.
