Homebrew Freeshop gets DMCA'd on Github...

Why they can't just apply a protection?
For example, if you try to download a file, it'll say "This server requires HTTP Authentication"
Because they would have to change the console side too, which 1- is work, 2- anything they add can be ripped out and made available to other downloaders, since the system is fully hacked at least for the purpose of this discussion
 
I can vouch that freeShop does not decrypt contents. You can feed data from Nintendo's CDN servers directly into the AM install functions. All you really need is a ticket with the title key so the system itself can decrypt and run it.
Even if what your saying is true you still have to circumvent the systems security to achieve what it does which I imagine is what they are against the most.

FreeShop doesn't bypass that security though, CFW does. There's no security bypassed at all with FreeShop (CDN has no security, CFW bypasses sig checks, all FreeShop does it pass data to the AM module)

And banned just because of some of their art and because it makes ppl dl stuff? Well, they would have had banned emulators then as well like already 20 years ago.
I'm still waiting for the day where they DMCA ppl who sell plushies, arts, cosplays etc. of their characters

Nintendo did try to fight emulators and ROM dumping.
They ultimately lost and the Supreme Court ruled that it was legal to make backups for archiving purposes..

Dont even try. The logo area AFAIK is the red 3ds logo + the wave animation and NOT the banner.
You'd have to rebuild the exefs of the CIA without using the licensed Ninty logo (something steveice already implemented into the buildtools repo some hours ago)

So it would be simple to remove. But I don't understand why other app didn't get banned for these XD

Thats the weird thing.
They are claiming the 3DS Logo is under license and everything that isnt in their database can therefore be DMCA'd.... So retarded...

The more I look at the DMCA claim the less sense it makes. As already mentioned the app:

A. doesnt circumvent any goddamn security measures.
B. CDN isnt even protected
C. the logo is used in almost every CIA made with older buildtools wth

srsly tho if there wasnt the risk of any legal battle you could just replace the logo with the homebrew one and Ninty could go to somewhere where they can PLEASE UNDERSTAND that the stuff they are doing right now is like throwing a tantrum because of 33c3 lmao

Just like to point out every company does this. They saw their chance to DMCA the github and they took it. ElDewrito got the same type of bullshit when we accidentally published the exe of the game on github.

Simple workaround, just don't put that library in the github release. Why is this so difficult to grasp?

I'd like to point out that just about every homebrew app does this as well so you guys are all able to be dmca'd.


Nobody saw this the first time I guess I'll say it again. The actual DMCA has no reason to it other than to show that they can remove homebrew when they want, and that they've been allowing it all this time. You can be assured that this DMCA was probably an intern who suggested it and nothing more. There was absolutely no actual logical reason, but in the mind of a lawyer they've won, and now that Nintendo knows they can do this they are preparing this for any infringing githubs.

So you better actually delete that commit from history because you can report a previously incriminating github commit.
 
Like seriously has not a single person on this forum been DMCA'd before? The repo can literally be reuploaded with a different name and the incriminating stuff removed. When Github DMCA's anything it's always the entire repo no matter what it might actually be. They don't do single file takedowns as they would need to wipe commits and then it gets fucking messy.
