Just make sure before you update, you see the RX-E in the bottom-right corner of the settings screen!!
Are you taking out the SD card as soon as you see the final confirmation to format? Because that's what you should be doing.Huh that's weird.

Try installing Tiny Format to your Emunand then. All I know is that it's meant to safely format your 3DS without formatting your SD card.
