EZ Flash 3in1 battery dead after a few days?

I ordered an EZ Flash 3in1 from Shoptemp and today, I started up my DS Lite and my saves are gone, and it asked me if it could use the expansion. I looked up on this and apparently my battery is dead? Can I return it to Shoptemp and get a refund or get them to send me a new one?

I'd check what 3in1 it is with exploader, it's possible it's an older 3in1 (not the plus) which the've had for a while.

I checked with exploader and it is a normal 3in1, not the plus variant.
