I wish gamestops would be more proactive in checking for banned consoles. With the 360 they started making sure they weren't banned by scanning the serial, not sure if they still do that on the new consoles. I bet there are plenty of people who buy a 3DS or other console for their kids and never realize it is banned until after the return window. That sucks.

That would make for a good lawsuit, I think they got sued one time because a code for a game didn't work for a customer, the code came with the game and all. I'm not sure if it was used or not but I need to look it up to see the outcome.

Something just stuck my thought just now. I just realised that Gateway's emuNAND uses a temporary file in RAM in which is executed to run limited commands from the ARM11 cores. Nintendo could very easily find out if I'm using the emuNAND function or not, just by what is stored in RAM. So even if the actual NAND didn't have any modifications to it, Nintendo could still find out that I'm using emuNAND, just by reading the contents of the RAM while connected to the internet. I would assume the information of contents in the RAM do get sent to Nintendo's servers. Uh oh.

well the important point is that it doesn't exclude it either. If Nintendo wanted to really clamp down on piracy, they would have all the tools at their disposal to do so.
Depending on whether or not the log that they keep record of gives information about what type of game it is. Now if it DOES, then there's no doubt they have the legal authority to look at it.

instead of banning ppl, nintendo should just send code that bricks the console
Woah there Hitler, let's talk about this!

Only way a lawsuit would be justified would be if they lied and said a used console was new (and also happened to be banned) or if the refused to take it back and give a refund.

Well I was about to report that I was the first since I had an error message when checking F-list (a different one mind you) however upon entering emunand and checking friendlist I was online.. So I'm good.. for now..

But it hasn't happened to people with CIA yet. Lets not confuse people.

Actually I think there was, check the list:

SuperSVGA
Flashcard: Gateway 3DS
game type: CIA
header type: none
SysNAND: 4.5
EmuNAND: 9.5
used header: none
eShop/Miiverse blocked: no
other games blocked: yes
played games: The Legend of Zelda: Ocarina of Time 3D (CIA), Pokémon Omega Ruby/Alpha Sapphire (CIA), The Legend of Zelda: A Link Between Worlds (3DS ROM, headerless)

Yeah... I think that was a mistake. I think I remember reading that report and then him fixing it. Can SuperSVGA come here and clarify?

Edit: He said this
Okay, this is odd. I have three emuNAND SD cards, FW 9.2, 9.4, and 9.5. I only get the error on my 9.5 SD. I'm going to try updating my main 9.2 to 9.5 and see what happens.

I'm assuming there was a mistake.

If they are not already logging that information, they can easily add it in the next firmware update. It all depends on how badly Nintendo wants to stop piracy.
