Something else I thought of. Does any of the cases have a linked Nand? I noticed a large majority of people are Sky3DS users on regular NAND. I wonder if unlinking the sys from the emu could make it any safer? If CIA are on the Emunand but they are linked it could raise questions on the system. Maybe it could cause detection of CIA installed games. I know I unlinked my nands because it kept moving my downloads from the eshop to default places on emunand.

I think all unlinked NANDs cause is a change on SD card encryption.

still no official statement from nintendo..

there was that japanese email

Nintendo has already made it's statement when it lobbied in the US Congress to help fight against piracy a month or so ago. Don't expect Nintendo to straight out tell everyone how they are stopping the pirates. If you're caught you will be banned. Plain and simple.

Can we add another question to the ban form? Ask if they had a NNID attached to their 3ds, if they have a Wii U attached to that NNID, and whether their Wii U can access online services if both of those are answered true.

they don't seem to show mercy at all, so banning a linked wii u wouldn't surprise me

So has any banned member sent in there system yet? As long as you have a backup of your nand on the 3ds/3dsxl you can do the hardmod and downgrade again. Those who have n3dsxl/n3dsll, no confirmed hardmods.

so... the ban only occours in sys9.5 and emu9.5?
any reports about banned in sys and emu below 9.5??

only my 3ds xl is in 9.5 sysnand

my other 2 3ds are in 9.2 sys + 9.4 emu
and 4.5 sys + 9.4 emu

anyway... the only game i play online is pokemon and mk7 wich i have both retail carts
i should be safe for now

i have a sky3ds... i also have a load of original carts i was about to get rid of... how can i get the headers from these before i sell them?

Is it legal for nintendo to do such a thing? even though we using illegal roms?

Dude, don't be an asshole. You are going to get yourself and some 12 year old out their banned if you go ahead and rip your header for Smash Bros and turn it in. Plus, to what extent will your greed continue to grow? But maybe that 12 year old that used a legit copy from Gamestop will call and bitch out Nintendo, discouraging them from continuing this banning process they started.

I don't think a 12 year old would have much leverage against big N, their parent's though? Probably not. They would have to go after Gamestop and Gamestop would have to go after big N to resolve those kinds of issues I think.

Tested mine yesterday night and no ban for me. I use gateway, emunand FW9.5 and all my 3DZ games use a hearder I got from my original PES2013.

I remeber using a homebrew in the past, autocoinsetter and it registred a log at the recent used games on my 3DS. When I saw that i immediately removed the homebrew and deleted all the log related to it from my system.

Maybe the people get banned has a residual log of something unofficial on their systems. Can't that be possible?

I don't believe I've been affected by this, but confused how its happening exactly...
I've only been playing offline games at the moment I believe, and the games I have which I believe do have online functionality, I havent played online with them, and they are installed as CIA files (e.g. Bravely Default, Pokemon Omega Ruby)

Is there anything I should be doing to prevent a possible ban?

How do you remove logs related to it? For example I have play coin setter and that shows up in my activity log I believe as recently played, which you can remove from the book, but you can't remove from daily records.

anything is possible and if nintendo has learned anything from other big gaming companies.. like microsoft..anytime you connect to the internet data gets transmitted..even offline a log is kept in the nand then when it has internet connection it sends data to microsoft (M$) nobody knows if nintendo is doing the same thing but it would be silly not to

I remember selecting it on the records album.. that one that shows how much time you've played a game.. and deleting it.

But I think that if you use for a long time it can send data for the eshop.. where you rate the games you played.
