Yeah he is in Japan but Nintendo wouldn't send out a warrant just for Smea's arrest because "3ds homebrew tools". Nintendo has bigger fish to fry than one haxor on the internet.

Than isn't it just a modified computer language compiler (c++, java) with emulator support. I don't see any reason for it to be taken down since its kind of like other program compilers.

Based on the logs, Wintermute was suppose to help smea on something for 33C3 about the 3DS.

However, regardless of what is really hapenning, let just hope both of them are ok and don't have serious issues.
