so i just cfw my old 2ds with boot9strap and i was wondering now that if you use freeshop you will get banned, if i was to install a cia game like smash bros will i get banned for that?

this wont work . . . or more accurately freeshop does not work, nintendo fix the shop verification process in such a way that freeshop is dead forever

not at all . . . things that can get you banned are
1. trying to use the eshop to re-download games you did not buy
2. cheating online
3. playing a game before it comes out
4. using homebrew in a way that nintendo can detect . . .let me explain, your 3ds reports to nintendo the app you currently have open whenever you are connected to the internet, if its a homebrew app you installed as a .cia via fbi nintendo can tell, but if its a homebrew app you never "installed" and instead use the .3dsx version via rosalina nintendo cant tell. in addition to reporting your currently open app if you have no app open when you connect to the internet it will report the last app you did have open ... so number 4 is really a two part
4.1. use 3dsx versions whenever possible
4.2. run .cia homebrew offline and run a official(licensed) app before connecting to the internet

so i am perfectly fine if i install a cia version of the game as long as its not from freeshop?

Yes, that's possible. You can go online with pirated installed *.cia games. Although rare and almost unheard of, it is possible to download fake *.cia that can brick your 3DS. Just make sure you get "clean & reputable" (lol) sourced roms from those [...] sites; don't ask us where to find them as this is against forum rules.

Make sure your SpotPass is turned off in System Settings, you don't pick a homebrew app as your favorite title in Friends List, don't cheat in online games especially with impossible stats or acquired items (just don't cheat at all), and don't install and play games that haven't been officially released yet in your region.
