According to Wikipedia (the source of all True Facts), if trademarks are not enforced, anyone can apply to have the trademark unregistered by the U.S. Patent and Trademark Office.

Given the level of crap being pumped out by game companies, homebrew games cannot be considered inconsequential.

The first time I heard about this aspect of trademark law was about ten years ago, when 20th Century Fox issued a C&D to a group that was developing an Aliens vs. Predator conversion for Quake (I think, it was for whichever Id Software game was current at the time). The conversion was almost guaranteed to be better than 20th Century Fox's AvP game, which sucked infected goat anus.

It would be hard to sell a crappy game if a good version is available for free. Beyond that, if the trademark was disputed, they would have to make a case that they thought the homebrew game was inconsequential. Going the C&D route would prevent that, and probably cost them a lot less money.
 
@bot, I really enjoted AvP, the 3 races were great!

still I donno why he wouldnt make a clone and name it not too similiar to Castlevania. he could still use some textures and even level designs and stuff.

dont want to see same thing as Giana Sisters (anyone remembers? without Wikipedia!) happen to his engine.

2. How does that make a difference in the eyes of copyright holders?

behind every post? I was just stating the facts. If it violates their copyright, a company isn't going to care if the project is open source (except that it will probably be harder to squash).

IIRC same goes for copyrights, but they are giving more and more and more leeway to the various trolls, and others.

They're also giving them more leeway for improperly marked copyrights, which are supposed to be:
copyright, copr., or the ©, followed by a name AND date.
( C ) is not a valid copyright indicator, nor is one lacking a name or date. (spaces to the parenthesized C were added so that the dumb board software doesn't turn it into the valid copyright symbol.)

AvP, while I obtained a Jaguar a few years ago, I never managed to locate a decently priced copy of AvP and so missed out on what was supposed to have been one of the best, if not THE best game for the Jag along with that other tunnel shooter on rails sort of thing(forget what it's called, as it never interested me). I managed to track down a bunch of other good/rare games though, although, sadly the CD units are also overpriced along with the games even though I know of at least one stores sitting on hundred of new boxes of them. Probably makes collectors happy though, as it keeps the supply in the wild down unless that guy just decided to cut his losses and dumps them.

A good DS port, official or otherwise would be nice to see of that, as I also never bothered with the PC or other system ports as I wanted to play it on the system originally deisgned for.

I'm interested in his engine for a game I want to do, speaking of which does anyone know of a decent open source 2D engine available on the net?

I would like to know if one that can do high res textures and similar in capability to the SotN engine if something like that exists.
I'd figure if anyone knew you guys might be able to point me in the right direction.

I still have my Jaguar. I never owned AvP either.

. Although the other game you are talking about sounds like Tempest 2000, which is a sweet game. There is a freeware port/clone called Tsunami. I agree, they should make a port of Tsunami.
 
If it didn't have the name Castlevania on it half of you wouldn't be reading it. It's a strange way of thinking but maybe using the name to get people buzzing about the project then changing the sprites, genre, etc to keep Konami happy for the second "press" release isn't such a bad idea after all. It's a good way to show the part of the community that completely ignore homebrew what they're missing. Not that I think that's what the developer's thinking, but it's fun to think outside the box sometimes
