It's because cias don't use headers. So there's no way for Nintendo to tell if you're using a legit eshop purchased game or not. The only way they can catch you is if your CFW doesn't support region free patching to use out of region games online.
That's the assumption, but we still dont know for a fact. I've been using 3dz scene dumps (private header) for a while now. No ban. By thats not to say they have no way of finding out. Right now its just an assumption.
 
I play out-of-region CIAs online and I have no problems. I play JP, EU, and US (Native) region games. Including TriForce Heroes, Monster Hunter X, Animal Crossing: New Leaf, and some others.

That doesn't mean you won't get banned, it just means I haven't been banned.

i do hate when people assert that things are 100% safe, playing any pirated stuff is never going to be 100% safe, im sure it would be trivial for nintendo to verify NNID's to purchases, its just that so far they havent appeared to be ban hammer trigger happy, these things could obviously change.....especially around the time of breakthroughs that might cause a huge influx of pirates such as downgrades becoming available to the masses :wink:.....basically if you don't want to be banned don't pirate or cheat at all, if you decide pirating or cheating is more important dont kid yourself that your 100% safe :P

Cias are 100% safe for now. Even out of region cias.

i prefer the "there are no reported cases of people being banned for using cia files", and it wasnt directed specifically at you, just everyone in general who are assuming they are 100% safe using cia files and it would be impossible for nintendo to suddenly decide to start banning people playing eshop games that they have never bought, it should be trivial for Nintendo to see/verify your purchase history and issue bans based on that info

all we can do is hope nintendo stay mellow and dont go all nazi like sony/MS when it comes to banning consoles indefinitely etc

Erhm. It can't be a fact. The word, fact kind of doesn't work here. If that's what you meant, then they're not 100% safe. If it's a for now instance, that can't mean 100% certainty. That'd make 0% sense.

Ok. I know what you mean and it's the same reason i wrote for now. At any moment a new banwave can can come for cias too so it's not 100% safe at all. You are right. I thought it was directly to me since I'm the only one who said the 100% thing on this thread. :P

Although, CIA files don't mean piracy all the time. These can be legal back up of owned games. Nintendo has no way of seeing if the person owns the cart or not. So, given that the owner used a legally owned game, they cannot do what Xbox does and issue any console bans. Maybe matchmaking, but not on the console. It's totally legal to use CIA files if they are legit and legal

well MS/Sony bans are just online bans, and legal backup or not if you violate the EULA you can have all online/eshop access rights revoked, same as with MS/sony, they don't care to try pursue you in court to prove you pirated, they just have to have sufficient proof you were running a unauthorized copy/software, which would even be a cia of a legitimately owned title, legal or otherwise
 
if you don't want to get banned then don't use public headers. Not fucking hard. Use cia, and if you can't because you updated 10.4 then too fucking bad. We gave you two weeks of warnings and tutorials on how downgrade. And if nintendo catches you using a public header it's not just an NNID ban it's a console ban.

My eyes see that the law is flawed. Be that as it may, Nintendo isn't going to ban me. yeah tbh nintendo consoles dont loose out much by keeping them offline, probably why they havent bothered banning people really as the general reaction would probably just be "awww shuchs.....oh well nvm"
 
Only a handful of games are worth playing online. To that end you have two options 1. buy those games legit or B - take you chances and hope all goes well. I almost never play online so if I am banned I might not even notice.

Okay, probably. Since there's 178 pages in that thread and that was the first case with CIAs in like 4 pages, I guess so.
yeah and the guy who got the ban bought the console off someone who owned a SKY3DS so we can assume there was a ban reason
