I personally believe their is an kernel exploit/backup loader method that isn't patched.
The only thing is it won't be released till Nintendo has given up fully on the 3DS line of handhelds.

Even after the 3DS was out the DSi was still receiving 1 or 2 last updates and flashcarts still work on them.

I believe the Wii completely stopped with updates a few years before the Wii U came out.
