So if i were to mod my New 2DS XL and downloaded games for free and played with those online with friends, would my NNID banned?
I did read a Discussion saying that bans are now rarer, is it still a possibility? (My NNID is very new so i'm asking)

NNID doesn't matter, especially if you don't even have any purchases on it. You don't even need it to play online, and they don't ban NNIDs for that kind of stuff anyway, only console IDs (more specifically, localfriendcodeseed.) This isn't really done anymore outside of people cheating online and whatnot. They've all but moved on to the Switch.
NNID bans are extremely rare and only happen under specific circumstances. If you chargeback a purchase, or pirate a game and play it online before its official release. You probably don't need the NNID to play online, regardless.

I downloaded WarioWare Gold from *snip*, if i were to play it online would my NNID be safe or would it be tagged?
And would it be the same for New Super Mario Bros. 2
I think any download without the tag Legit CIA would make my 2ds tagged
