Can ninjhax even be blocked by a firmware update? It exploits a flaw in Cubic Ninja, not in the OS itself. The way it's made, is it doesn't need any prepared savefiles, so Nintendo doesn't even have a thing to block, from my understanding of the matter. The way to fix the Ninjhax entry point, is to patch the game itself. Not a probable course of events - studio responsible for CN closed up.

Not really, everything stays in usermode.

Btw., I'm pretty sure they'll be able to patch this up, for example by looking out for a specific sequence of API calls triggered only by Ninjhax.

Notice the changelog for the region:
9.0.0-15 to 9.3.0-16

They are on a totally different system of firmware updates over there, getting different features at different times, different security updates whenever Nintendo cares enough to update them. Odds are it is the equivalent to our 9.2.0-20. At worst, it is a slightly updated version for their specific region. This is absolutely no indicator that a new firmware update is coming to the rest of the world
