I have found a 3ds xl with a serial starting with SW1165
does that mean that it's on a old firmware? coz I want to use fbi.

I have found a guide for N3DS serial numbers but I couldn't find one for 3ds xl.

if its new in box and has not been opened and returned its guaranteed to be under 9.2. As far as I know new in box highest is 8.1 and that's the NES retro edition

yes you should be fine since old 3DS Emunand supports up to as of now 9.9
