Hacking 3ds Rom card question help?

I've never owned a 3ds XL or 3ds and plan on getting one for the first time. Since only Gateway is known it run both DS and 3DS Roms, will it work on a brand new 3ds XL bought after October 2013? I read that it only works if your 3ds is version software 4.0 something. I assume any brand new 3ds bought would be updated to the newest 6. something software. Would it be a bad idea to buy a Gateway with a brand new 3ds XL? thanks

If buying an XL look at the back of the box. if it says copyright 2012 you have a gateway compatible 3ds.
